Distúrbios mentais como fundamento para a exclusão da responsabilidade penal

Os efeitos dos distúrbios mentais sobre a responsabilidade penal parecem ser mais ou menos os mesmos em todas as jurisdições. No entanto, se olharmos mais de perto, os pormenores dos tratamentos legais e as conse quências práticas são bastante diversos e esta discórdia aumentou consideravelmente nos últimos 30 anos. O presente artigo realiza um breve levantamento comparativo com ênfase no direito penal material, a fim de esboçar uma matriz normativa apresentando a existência de três abordagens básicas para lidar com os distúrbios mentais como causa de exclusão da responsabilidade penal. Embora a psiquiatria tenha feito progressos consideráveis nos últimos 150 anos, ao proporcionar um tratamento mais humano aos que padecem de enfermidades mentais, é uma observação perturbadora que o direito penal parece ser significativamente menos tolerante para com os infratores que padecem desses distúrbios nos tempos modernos do que há dois milênios atrás.
