O presente artigo emprega a análise histórico-comparada para discutir o processo penal no contexto do poder penal no estado liberal moderno como direito penal e polícia penal – o estado penal dual. Com foco na Alemanha e nos Estados Unidos, ele considera duas formas de pensar o processo penal, a partir de perspectivas paralelas correspondentes a dois modos de governança do Estado: direito e polícia. A primeira é característica do estado de direito (Rechtsstaat), ao passo que a segunda pertence ao estado de polícia (Polizeistaat). A ênfase da análise está no processo penal que é consistente com a busca do ideal do direito liberal com o qual os Estados que se consideram – ou desejam ser considerados por outros – como participantes do projeto jurídico-político liberal moderno estão comprometidos.
