Abstract

This paper examines the constituent elements of the offense of rape under current Brazilian criminal law, which adopts a coercion-based standard, contrasting them with those required by foreign legislation grounded in different criminalization models, such as the negative consent model (“no means no”) and the affirmative consent model (“only yes means yes”). Drawing on hypothetical cases, the article discusses the limits of punishing non-consensual sexual acts under existing legislation and proposes doctrinal criteria for interpreting the crime of rape as defined in Article 213 of the Brazilian Penal Code, with a focus on the concept of violence as a means. It is argued that, although models based exclusively on consent are preferable for enhancing the protection of sexual self-determination, their application in Brazil requires a legislative reform, in order to avoid violating the principle of legality.
