Abstract

Apesar de seu “ressurgimento” nos últimos anos, a teoria da retribuição é rechaçada praticamente de imediato pela opinião dominante na Alemanha, em razão de uma equiparação com as teorias da pena do idealismo alemão. Entretanto, esse posicionamento ignora o desenvolvimento que a teoria da retribuição teve nos últimos anos, especialmente no âmbito de discussão anglo-saxão. Neste trabalho, será apresentada esta última discussão, com o intuito de demonstrar que a teoria da retribuição é muito mais complexa e refinada do que acredita a opinião dominante alemã.
