Abstract

Since the Enlightenment, the prohibition against double jeopardy has attained constitutional status in many jurisdictions and is now a recognized human right. However, Beling had long pointed out that the “most appropriate essence” of res judicata in criminal matters was to “quell emotions.” This counterintuitive nature of ne bis in idem often leads, repeatedly and across many legal systems, to heated political and legal debates, with the German controversy over § 362(5) of the German Code of Criminal Procedure being just one of the most recent examples. This paper does not seek to address detailed issues of any specific legal system, but rather, in a more comprehensive manner, the question of the basis and purpose of this notably unpopular human right.
